civil cases

civil cases

The civil litigation process begins when a person or entity files a dispute against another person or entity, suing for compensation for damages caused. The judge or jury listening to the case will then apply the appropriate law to the facts presented in court by both parties. The plaintiff files a complaint in court seeking monetary compensation, an injunction, or order as a result of an action by the defendant.

land dispute cases

Disputes over the right of land use between land users and other organizations or persons in connection with the appropriation or withdrawal of land from the users, with the system of land management, and with the exercising of other functions of disposal and control of the land.

family case

Family cases often involve disagreements between parties. These are called contentious cases. Disputes can occur over various issues. Common examples include disputes over divorce, maintenance of a spouse or child, or the authenticity of a will. If an application is successful, the court may order someone to do something (such as to pay maintenance) or grant a certain status (such as divorce). This is a private dispute. This means the state is not involved, except to provide the judge and court services.

Mediation and Others

Mediation is a process wherein the parties meet with a mutually selected impartial and neutral person who assists them in the negotiation of their differences. Mediation leaves the decision power totally and strictly with the parties. The mediator does not decide what is "fair" or "right," does not assess blame nor render an opinion on the merits or chances of success if the case were litigated.
